The original contract will clearly be upheld, verbal or not. The parties have performed it so it is evidenced clearly by conduct. The party performing must be paid, or the lassie is being unjustly enriched.

The key is to identify whether the variation is valid or not. Needs accord and satisfaction to be valid. Accord exists if the agreement is genuine. It probably is, as she 'reluctantly agrees'. Reluctant agreement is still agreement - you don't need to be happy when entering contracts. If he paid the extra two gadges, he has satisfaction for the variation, so the variation is valid and he gets paid. If he didn't, he gets the original agreed sum because he suffered no additional detriment for the extra dosh and the variation fails. He also probably commits fraud, per Derry v Peek.

Like I said, simples really. There are loads of other supplemental arguments to be made on little bits and pieces but that it the core of the problem and where the litigation would go. Put that down, with the requisite cases, and you get a pass mark at least.

I've really fucked up, career wise. I had a look at how some of these bums are doing and it's amazing.

I never used to agree with Hut and Clogg when they said most of the "High Flyers" were sociopaths but there is definitely some disassociation happening with these fucks.

You'll get nowhere in life trying to be too good and having fear of being found out. If I ever saw a younger lad at work and he'd be fretting "Oh, you think that's good enough"....I'd learned to say "Mate, you are sweating, you are grimy, you've done what they have asked you to do, they ain't paying you shit and it's tea-time, so well done, it's fine".

But when I was 20 I didn't have that mentality.

Years and years ago, it just happened that while I was in University I got this shitty night shift job as a security officer. Ireland was "Booming" and the new Financial Services center had all these banks and law firms. Goodbody's, Deutsche Bank, Bank of America, you name it. We all know what happened next but I digress.

Anyways my old man asked me "how do you get one of these jobs" and I showed him {long term unemployed, couldn't apply for a sandwich} and he got himself a night shift in Goodbody's. My shift finished at 0600 and his at 0800. I used to walk down to meet him and sit in the lobby of Goodbody's until he was ready to leave at 0800.

One morning some fuck came in early ready to rack up some billable hours and started buzzing the door like mad and bellowing "Come on! Come on! I've got to go to work". I look back on that incident and I realize now that guy was totally fucked.....incapable of politeness, probably exhausted and half-cut from the night before, scared of some impending workload, scared of some kid coming up behind him.

Fear is a bastard. All these big firms and their big fine people are really just terrified, self-centered, totally insecure fucks who wing it in life and were taught by their parents how to wing it and groomed for a life in winging it.
