Pacquaio files lawsuit against Tim Smith of the NY DailyNews

    I guess based on this piece of the article...

    This isn't some issue that just came about. It has been a part of the contract negotiations for weeks. According to a source familiar with the talks, Pacquiao's representatives asked what penalties Pacquiao would face if he tested dirty, and also if a dirty test result could be kept secret so that the integrity of the fight wouldn't be ruined in the public eye.

    And the argument that he would be weakened if he were to take a blood test the week of the fight doesn't hold water.

    "The amount of blood taken is so small it will have zero effect on performance," said Dr. Gary Wadler, the World Anti-Doping Agency chairman of the Prohibited List Committee. "It's really inconsequential when you take into account the total blood volume in the human body. It's not a valid argument."

    This is journalism 1-0-1 and is the reason I didn't bother responding to it when IMDAZED posted it in the other thread.

    Here's what happens. Journalist A has fuck all worthwhile to report on a major issue so instead cites a 'source' who just so happens to have overheard some incendiary information worth reporting, so Journalist A, who of course absolutely isn't at all making up this 'source' and his 'information', reports the 'information' as his story, knowing that, in the vast majority of cases, he is protected from civil liability by a variety of free speech laws.

    In other words, it is complete bullshit.

    I hear what your saying but unless Pacman goes through the tests from now on this issue will be brought up. Everytime his name gets mentioned this PED issue will also come up. It's a simple fix in my view. Get tested, Make 25 Million dollars and try to knock PBF's head off.

    When Kostya Tszyu streched Judah thinner than Communion Wafer, Tim Smith jumped in the ring and KEPT asking Judah if "the fight was stopped early, was it stopped early, do you think it was stopped early...." as Judah struggled to regain some semblance of lucidity and consciousness.

    The man is an insufferable moron, it doesn't surprise me that he is beings sued.

    I think unless he actually fails a test, or there is some hard evidence that proves he is taking PEDs, it'll blow over in due course.

    Tim Smith is an excellent newspaper man and if he reports that Pacquiao's representatives asked what penalties Pacquiao would face if he tested dirty, and also if a dirty test result could be kept secret so that the integrity of the fight wouldn't be ruined in the public eye. I tend to believe him. The guys been on the boxing beat for years, won the Nat Fleischer award for boxing journalistic excellence and you think he doesn't have sources close to the negotiations? c'mon man.

    Firstly, if he did have a source, why not name the source? Why not provide evidence in support of this claim instead of simply making the claim? Any old newspaper reporter, good or bad, can simply cite 'a source'. It not exactly a new trick, is it?

    Secondly, if he really DOES have a source, it couldn't be too hard to track that source down. I mean, how many people can have had the kind of access to the negotiations required to actually hear that discussion and relate the information? Moreover, why would that person put himself in such jeopardy, knowing as he or she must that there would be a very real threat of legal action and likely serious repercussions for their career?

    If you 'tend to believe him', then that is your business. I, on the other hand, rarely believe a word that journalists say, because they are PAID money to write things to sell newspapers. That means they are biased.

    Inherently so, in fact.

    Well...why not tell Dim Smith to "just name the source"....

    I bet his "source" is some disgruntled ex-employee of Pacs or Wild Card gym, some hanger-on who never got the credit or the money he thought he deserved.

    Thats right. People are convicted on circumstantial evidence...they are also acquitted when their gloves dont fit....and besides, we aint even got to Court yet, thanks mainly to to the reticence of people who would prefer to take it to the street. :rolleyes:

    As for the "upper echelon" of Boxing scribes , that is not much of a claim. Boxing has some of the worst "experts" and "pundits" in all of World Sport.....so being "up there" means nothing. Lets face it, Dan Rafael is a "top scribe"....and we all know about his recent, high-profile bloopers.

    Boxing Journalists have traditionally been in the pocket of managers and promoters, if they dont tow the line they dont get any copy, and thats always been the way.

    Steve Bunce missed out on a lot of copy in the 80's because he wouldnt do what Mickey Duff told him to.

They're just the glue that power's a democratic society, but If you think a professional newspaper man regularly makes shit up then by all means hold your current position....and furthermore if you've never seen or heard a credible story with an unnamed protected source then you don't read much newspapers and your opinion is worthless.     Which is exactly my second point. What person in their right mind, close to Manny, Roache and Arum, would disclose this kind of information, presuming that anyone actually DID make a disclosure?

    The risk to such a person would be HUGE. Fucker would be fired and would never get a similar job elsewhere. He's also potentially PERSONALLY liable for defamation in a civil court. This makes it extremely unlikely that anyone actually would RISK leaking anything like this IMHO.

    Which is why I suggested that any such a person, should they exist, would already be out of a job or on the verge of being out of one, or have nothing to lose to begin with.

    And, with Pac in the process of getting paid, why would anyone want to risk losing out?

    Smith lost any credibility he had long ago...and besides, as a "Scribe", he is wide open to being owned, on one or level or the other, by managers, promoters, fighters themselves even. Its the nature of the Sport, writers have always relied on the promoters, and, to a degree, the promoters rely on the writers.

    With the proliferation of internet and other media outlets, the relationship has definitely shifted against the writers and in favour of the promoters, If one writer, one website wont represent certain views, there is always another one around the corner.

    Its not like the days of Harry Greb, where the newspaper men could effectively decide who won the fight.

    I read lots of them, just so as to be able to say they are limited in their usefulness.

    In fighting, the result is key. Its where most fans start {where they have not seen the fight}

    So, you log on and find out what happened. Fightnews, Boxrec, all have the result up fairly fast.

    Then, if you want, you can read the articles. Most of them are crap. Most of what Maxboxing have produced is crap. Biased crap. When you have 10 out of 11 guys picking the wrong guy to win a fight, you really dont put too much stock in their articles.

    Do they have a use? Yes. But they are all owned by someone, to one extent or another.

    Dude, you have absolutely no fucking idea what you are talking about. Seriously, none. It is universally recognised by almost any credible academic source that 'news' reported in Newspapers has very little worth as credible information.

    I should know. It's is my job to teach precisely why this is to each and every one of the students who walk into my Law and Criminology classes.

    As one academic once stated: "There is no such thing as news until someone, somewhere, actually deems it newsworthy"

    Of course, my opinion on this is worthless, even though it is my JOB to research, analyse and teach this exact sort of thing...:lol:

    Hell, I even have a full powerpoint slideshow of quotes, materials and research links which I deliver to students on this very topic. But what do I know? Gimme your email address and I'll educate you, you arrogant fuck... :lol:

    You ever heard of Piers Morgan? The smug prick on America's Got Talent? He was editor of the Daily Mirror in the UK not so long ago.
