What do you know about the duty of the prosecution to inform or disclose a shortcoming they've become aware of in the veracity of their expert witness?

Specifically the fact that the expert, whose report they are about to rely on, has been struck off in the interim?.

A lawyer who intentionally misleads the court commits contempt, so it depends on the nature of the shortcoming. Sometimes, nothing needs to be done. Sometimes, you need to get a new expert. Lots of positions in the middle

Well some lads been in jail for 9 years cos the forensic pathologists report was relied 9n by a prosecution who knew he'd been struck off for being useless. I'm scouring the books and can find fuck all about it.

 

The chances are that the fault lies with the defence lawyer in that case. Really, it is for the defence to do their homework on the expert being relied upon. Something like that is a bread and butter check, followed by a simple cross-examination. If the expert or the prosecution lawyer mislead the court, they are in contempt.

I'm intrigued about at what point the CPS could be said to have had constructive knowledge that the testimony of their expert witness was so unreliable as to trigger their duty to inform the Court that the guy had been struck off.

If even that's the case. Maybe the test is that you need to have actual knowledge that the testimony is so totally unreliable as to be not just worthless but actually unjust.

 

That's our other tack. Flagrant Incompetence, the bar for which is high, very high..
